1. Introduction
This Privacy Policy explains how our company processes the personal information that customers have entrusted to us. Please read this Privacy Policy carefully before providing us with your personal information or using our services or products. Chapter 1 of this Privacy Policy describes the outline of our use of customers' personal information. Chapters 2, 3, and 4 describe region-specific information for customers who are located or reside in the European Economic Area/the United Kingdom, the People's Republic of China, and the State of California of the United States respectively. Other policies may apply to our products and services. The details of such policies will be provided together with the applicable terms and conditions of services.
2. Scope of Application
This Privacy Policy applies when you provide us with your personal information or when you use our services and/or products.
3. Purposes of Personal Information Use
We use personal information for the following purposes:
- (1) To provide our products and services;
- (2) To plan, conduct research on, develop, and improve the quality of our products and services;
- (3) To respond to your inquiries;
- (4) To provide information about our products and services;

4. Personal Information We Obtain
To achieve the purposes of use specified in the preceding Article, we obtain personal information as listed below through appropriate and fair means:
- (1) Name, information regarding affiliation (company name, organization name, department name, title), address, phone number, and email address; and
- (2) Information required to achieve the aforementioned purposes of use, including, but not limited to, sales and installation information regarding our products and services.
Unless otherwise prescribed under laws or regulations, or unless otherwise agreed to by you, we will not obtain or use any of your sensitive information ("Sensitive Information"), such as race, beliefs, social status, medical history, criminal history, or the fact that, if any, the customer has been a victim of a crime.
5. Your Choices
As a general rule, it is up to your discretion to provide your personal information to us. Please note that if you do not provide your personal information, the services we provide may not be available to you, or you may not receive campaign information or other similar information from us because some of the system functions will not work and will be unavailable to you, or you may experience other disadvantages. You may at any time modify your contact information, your settings regarding our provision of information, or similar matters, by a method separately designated by us.
6. Disclosure and Provision to Third Parties
Except under any of the following circumstances, we will not disclose or provide your personal information to any third party. Furthermore, unless otherwise prescribed under laws or regulations, or unless otherwise agreed to by you, we will not under any circumstance disclose or provide your personal information (including your Sensitive Information) to any third party. For clarity, the joint use of your personal information, or our provision of your personal information to our service providers, will not be considered a disclosure or provision of personal information to a third party.

- (2) It has been requested that personal information be disclosed or provided to the extent permitted under laws or regulations;
- (3) Provision of your personal information is necessary for protecting someone from death, bodily harm, or property damage, and your consent is difficult to obtain;
- (4) It is necessary to cooperate in the performance of the public duties of a national or local government, etc., and our requesting your consent may obstruct the performance of those public duties;
- (5) Statistical data (information that cannot identify individual customers) are disclosed or provided;

8. Outsourcing
In providing you with products and services, we may outsource part of that work to a service provider and furnish the service provider with your personal information to the extent necessary for achieving the purposes of use. In this case, we will enter into, with that service provider, a contract covering the processing of customers' personal information and the proper management and supervision of the service provider.
9. Transfer to Outside of Japan
If we provide your personal information to third-party business entities, etc. outside of Japan, including service providers and joint users, we will take necessary and appropriate measures in accordance with the stipulations of laws and regulations.
10. Personal Information Management
We properly manage the personal information we receive from you and take the best precautions against any divulgence, loss, and unauthorized alteration, etc. of your personal information. We provide our company officers and employees with in-house education and training on how to protect and properly process your personal information. We also set a storage period for personal information according to the purpose of its use, and once the purpose has been achieved, we will discard the information through an appropriate method.
11. Requests Concerning the Processing of Personal Information
If we receive a request from a customer, by a prescribed method, to either disclose, correct, delete, add, suspend the use of, or erase ("Disclosure") the customer's personal information stored in our database, we will first confirm that the request has been made by the customer himself or herself and then process the request as follows in accordance with laws and regulations within a reasonable period and scope:
- (1) Requests for disclosure: we will disclose the personal information items or purposes of use that the customer has requested;
- (2) Requests for correction, deletion, or addition: after we confirm the contents of the customer's request, we will correct, delete, or add the customer's personal information to the extent appropriate and possible; and
- (3) Requests for the suspension of use or erasure: In accordance with the contents of the customer's request, we will suspend the use of, or erase if so requested, the personal information items the customer has designated, to the extent appropriate and possible. Before making any requests, please note that, by suspending the use of, or erasing, your personal information, services that were available to you may no longer be available, or you may become unable to receive services according to your needs.
Your request may not be processed as requested if it significantly hinders our regular operations, or if it may be in violation of the stipulations of laws or regulations.

You may have to pay a fee when requesting Disclosure. For details, please read the description of the relevant request form. Different fees may apply depending on the laws and regulations applicable in that country.
13. Changes to the Privacy Policy
This Privacy Policy is subject to change. If changes are made to this Privacy Policy, a notification will be made on our website (www.noritzglobal.com). Please read the Privacy Policy thoroughly after any changes are made to it.
Chapter 2. Processing of Personal Information of Customers Residing in the European Economic Area and/or the United Kingdom
1. Introduction
Chapter 2 describes how we process the personal information of customers residing in the European Economic Area (hereinafter, the countries in the European Economic Area are collectively referred to as the "EEA") and/or the UK under the EU General Data Protection Regulation 2016/679 (the "GDPR"), the UK Data Protection Act 2018 ("DPA 2018"), and other domestic and international laws and regulations regarding data protection and privacy applicable in the EEA and/or the UK (collectively, the "Data Protection Laws"). Please note that the laws in the UK are similar to those in the EEA and that customers in these areas have very similar rights. Accordingly, references to the GDPR in this Chapter shall also be considered references to the corresponding UK laws. If you are under the age of 16, you need to have your guardian give consent on your behalf to the use of our services, or you need your guardian's permission for you to consent to the use of our services. If you are an agent applying for our services or otherwise enter information or perform procedures on behalf of a customer, you need to, before applying, obtain the consent of the customer himself or herself to our processing of customers' personal information. If there is any conflict between the description in Chapter 1 and the description in Chapter 2, the description in Chapter 2 shall take precedence.
2. Personal Information Controller
We are the controller of your personal information. In accordance with the Data Protection Laws, we protect personal information collected and/or used by the controller (a party that determines the method and purpose of processing your personal information) as well as by the processor (a party that acts under the written instructions of the controller).
3. Legal Bases for the Processing of Personal Information
We protect your personal information by processing it only within the scope necessary for specified purposes (purposes specified in Chapter 1, Article 3 (Purposes of Use of Personal Information)) in accordance with the Data Protection Laws. We process your personal information according to one of the following legal bases:
- (1) If you have given consent to the processing (Article 6 (1) (a) of the GDPR): normally, your consent will only apply to the processing that relates to (i) sales promotion and marketing and, in some cases, (ii) Sensitive Information;
- (2) If processing is necessary for the execution of a contract or to take steps to enter into a contract (Article 6 (1) (b) of the GDPR): normally, this is the legal basis for us to process any of your information that is essential for our provision of services, such as your identification information, contact information, payments, and travel information;
- (3) Processing is necessary for our compliance with a legal obligation (Article 6 (1) (c) of the GDPR): this includes, without limitation, the sharing of personal information with Customs, the Immigration Bureau, law enforcement agencies, etc., as well as our legal obligations to customers and our employees;
- (4) Processing is necessary to protect your life or the life of a third party, such as medical emergencies (Article 6 (1) (d) of the GDPR); and
- (5) Processing of personal data is necessary for the legitimate interests pursued by our company or by a third party, except when those interests are overridden by your rights under the Data Protection Laws (Article 6 (1) (f) of the GDPR): this includes the use of your personal information necessary for running our business, as well as for maintaining, developing and/or improving our products and services.
4. Requests Concerning the Processing of Personal Information

(1) Under the Data Protection Laws, you have the following legal rights:
- 1) Requests for disclosure: you have the right to obtain a copy of your personal information held by us as well as the details on how it is being processed;
- 2) Requests for correction or update: after confirming the contents of your request, we will correct or update your personal information where possible;
- 3) Requests for deletion: You have the right to request that your personal information held by us be deleted in whole or in part. We will review the contents of your request, and if the information you have requested to be deleted is not necessary, or if the law does not allow us to keep that information, we will delete that information;
- 4) Transfer of personal information: You have the right to obtain a copy of your personal information in a structured, commonly used, and machine-readable format. You may request the transfer of your personal information obtained by us as long as the processing of personal information is carried out by automated means based on your consent or to execute a contract;
- 5) Filing objections to the processing of personal information: You have the right to object to the processing of your personal information for (i) legitimate interests pursued by us or by a third party or (ii) direct marketing. We will suspend the use of your information unless we can demonstrate legitimate grounds for the processing of your personal information for our or a third party's legitimate interests that override your interests. If you object to the processing of your information for direct marketing purposes, we will suspend the processing of your information.
- 6) Restrictions on the method of using personal information: You have the right to restrict our use of your personal information under certain circumstances. If processing has been restricted, your personal information will, except for storage, only be processed lawfully with your consent, or if it is necessary for legal claims, for the protection of specific rights, or for important public interest; and
- 7) Right to withdraw consent: If you have given your consent to the processing of your personal information, you have the right to withdraw your consent at any time. Please note that this right is not unconditional and will not necessarily apply to all situations. Depending on the circumstances, statutory exceptions may apply. We may refuse your request under such circumstances. If we decide to refuse your request, we will notify you of the reasons for the refusal in our reply. Records of requests made to our company will be retained so that we will be able to prove our compliance with legal obligations.

(3) Response to requests:
We normally respond to requests within one month after receiving them. If necessary, we may request that you provide proof of identity or of the agent's authority to make requests on your behalf if you are making a request through an agent. If your request is especially complicated, or if you make multiple requests, it may take some time before we can reply in detail. Please be aware that there are exceptions to the above-mentioned rights. In that case, you may not be able to exercise your rights. If you are not satisfied with our response to your request, or if you believe that your personal information is being processed inappropriately, you have the right to lodge a complaint with a supervisory authority. 5. Sharing of Data Necessary for Providing Products and Services
We provide our products and services in cooperation with other companies and organizations. For this reason, we may share your personal information with third parties in order to operate. These third parties include:
- (1) Our group companies;
- (2) Organizations with whom personal information is required to be shared under laws and regulations, such as government organizations, law enforcement agencies, courts, Customs, the Immigration Bureau, and third-party organizations; and
- (3) Providers of various types of services and marketing partners.
If we outsource data processing to a service provider, your personal information will be processed under a contract that meets the requirements of the applicable Data Protection Law(s).
6. Marketing Communications
We distribute marketing information as needed to inform customers who want that information of our news as well as details about our products and services. Marketing information will only be distributed if you have consented to receive marketing information, or if you have purchased our product or service and did not choose to opt out of receiving marketing information even though you had the opportunity to do so.
7. Countries Where Personal Information Is Stored or Transferred
Our company is located in Japan, and many of our service providers and other organizations with whom we share your personal information are located in jurisdictions outside the EEA and the UK. Japan has been determined by the European Commission to be a country with an adequate level of personal information protection. When providing personal information to third parties, we will comply with the adequacy decision between Japan and the EU as well as the requirements of the Data Protection Laws including relevant Japanese laws and regulations. Please note, however, that this does not mean your personal information is protected by domestic laws in countries other than the EEA and the UK. 8. Storage of Personal Information
We store your personal information for the period required to achieve the purposes of use of personal information described in this Privacy Policy unless the law requires a longer storage period. If your personal information is not necessary for the purpose for which the information has been collected, or if so required under the governing law, your personal information will be deleted and/or returned to you in accordance with the governing law.

Chapter 3. Processing of Personal Information for Customers Residing in the People's Republic of China
The provisions of Chapter 3, as well as the provisions of Chapter 1, apply to the processing of personal information for customers residing in the People's Republic of China ("China") under China's Cybersecurity Law and relevant legislation. If there is any conflict between the description in Chapter 1 and the description in Chapter 3, the description in Chapter 3 shall take precedence.

2. Storage Duration of Personal Information
We store your personal information for the period required to achieve the purposes of use of personal information described in this Privacy Policy unless the law requires a longer storage period. If your personal information is not necessary for the purpose for which the information is collected, or if so required under the governing law, your personal information will be deleted and/or returned to you in accordance with the governing law.

5. Transfer to Countries outside of the People's Republic of China
If we use your personal information jointly with others or outsource relevant services within the scope of the purposes of use, we may transfer your personal information to third-party joint users or third-party service providers to have them process your personal information. These third parties include parties located in Japan and other countries outside of China. You are considered to have agreed to the following matters upon consenting to this Privacy Policy:

Chapter 4. Processing of Personal Information for Customers Residing in the State of California of the United States
The provisions of Chapter 4, as well as the provisions of Chapter 1, apply to the processing of personal information for customers residing in the state of California, US, under the California Privacy Rights Act of 2020 (the "CPRA"). If there is any conflict between the descriptions in Chapters 1 and 4, the description in Chapter 4 takes precedence.
1. Definitions
Chapter 4 uses terms defined in the CPRA.
- (1) The terms "sell," "selling," "sale," or "sold" meaning the selling, renting, releasing, disclosing, disseminating, making available, transferring, or communicating orally, in writing, or by electronic or other means, of a customer's personal information by our company to another business or third party for monetary or other valuable consideration. Under the CPRA, it is not considered a "sale" if we have entered into a proper contract regarding the processing of personal information with another business or third party.
- (2) The terms "share," "sharing," or "shared" mean the sharing, renting, releasing, disclosing, disseminating, making available, transferring, or communicating orally, in writing, or by electronic or other means, of a consumer's personal information by the business to a third party for use as data in advertising (behavioral targeting advertising), whether or not in exchange for monetary or other valuable consideration.
2. Obtaining and Using Personal Information
The types of customers' personal information that we may obtain in the future or have obtained in the past 12 months are as listed in the table below. We use these pieces of personal information for the purposes specified in Chapter 1, Article 3 (Purposes of Use of Personal Information). All of these pieces of personal information are obtained from the customers themselves.

- (ii) Information required to achieve the aforementioned purposes of use, including, but not limited to, sales and installation information regarding our products and services.
3. Obtaining and Using Sensitive Information
We do not use or disclose Sensitive Information as defined in the CPRA for any purpose other than those listed below:
- (i) To respond to customer inquiries and verify their identities.
- (ii) To provide products and services that are reasonably expected by average consumers.
- (iii) To ensure security and integrity.
- (iv) To provide services on our behalf.
- (v) To maintain or improve the quality and safety of products and services.
4. Sale and Sharing of Personal Information
- (1) We do not sell or share customers' personal information (including minors' personal information) to any third party, nor have we sold or shared any personal information in the past 12 months.
- (2) We do not disclose customers' personal information to any third party for business purposes, nor do we plan to do so.
- (3) We do not sell or share the personal information of users under the age of 16 without actively obtaining approval to do so, while actually knowing that such personal information is that of users under this age.
5. Requests Concerning the Processing of Personal Information
Customers residing in the State of California have the following rights regarding their own personal information:
- (1) Right of Access: a customer has the right to request, up to twice in a 12-month period, that we disclose the following personal information of the customer that we have obtained, used, sold, shared, and/or disclosed within the 12 months before the customer's request (the "Right of Access"):
- The types of personal information of the customer we have obtained and the sources from which the personal information has been obtained;
- Business or commercial purpose of obtaining, selling, or sharing personal information.
- Types of third party that we have obtained from, sold to, or shared personal information with.
- The specific pieces of the customer's personal information that we have obtained.
- Types of personal information that we disclose, sell, or share for business purposes.
- Types of third party that we have disclosed, sold, or shared with for each type of personal information.
- (2) Right to delete: A customer has the right to request that we delete certain personal information that we have obtained from the customer (the "Right of Deletion").
- (3) Right to correct: A customer has the right to request the correction of certain personal information obtained from the customer (the "Right of Correction"). We make commercially reasonable efforts to correct inaccurate personal information in accordance with the stipulations of laws and regulations upon confirmation of the receipt of an identifiable request from a customer.

2) Steps to verify your identity
<If the request is made by the customer himself or herself> If we receive a customer's request to exercise the Right of Access, the Right of Deletion, or the Right of Correction, we will first request that the customer provides enough information for us to verify their identity, such as their name and email address. We will then verify the customer's identity by checking the information the customer has provided against the information we already have.
<If the request is made by an agent> The customer needs to submit a power of attorney in addition to verifying the customer's identity as specified above in the section titled <If the request is made by the customer himself or herself>. We may directly contact the customer to confirm that they have given the customer agent the authority to exercise the Right of Access, the Right of Deletion, or the Right of Correction on behalf of the customer. - (5) As a general rule, we will not change the contents of the services provided to, or otherwise discriminate against, customers who have made any of the above-mentioned requests. However, please note before making any requests that, by deleting your personal information, services that were available to you may no longer be available, or you may become unable to receive services according to your needs.
